What is Trademark protection?

The most common types of trademark protections registered in Mexico are wordmarks, designmarks, DBAs, logos and mixedmarks( i.e… logo/designmark and wordmark together). Registration is also possible for commercial phrases, industrial designs and others.

Intellectual property protections are administered by the Mexican Institute of Industrial Property (“IMPI”). All of the same protections enjoyed in other jurisdictions such as the United States, Canada and the European Union, are provided for under Mexican law. The protections can be used to defend against others selling your products without authorization on e-commerce platforms, prevent importation of your products without permission, to stop others from using your company name, logo or even from designing products that are unacceptably similar to yours. These protections can extend to services as well. Many e-commerce platforms, such as Amazon, require a trademark to list products.

Do I need a Trademark?

Having a trademark is not necessary for beginning business in Mexico but is highly recommended. Some e-commerce companies like Amazon require having a trademark registration in order to sell certain products on their platforms. Here are some main considerations:

What Registering a Trademark in Mexico Involves?

Registering a trademark in Mexico first involves deciding if a workmark, designmark, mixed mark or DBA is right for you. In most cases, a mixed mark or DBA will suit most businesses needs. The relevant filings before the Mexican Institute for Industrial Property must be prepared and made. Final resolution is usually issued within 4 to 6 months

Trademark protection in Mexico is based on your business activity or what is referred to as a NICE Classification. The NICE Classification System is the international standard for defining intellectual property protections and consists of 34 classes of goods and 10 classes for services, for a total of 45 classes in all. Protection is only offered within the class corresponding to the business activity for which your trademark is registered. For example, the name LEGO would provide protected for class 28 for toys but not for a competitor in class 1 for industrial chemicals. You can also register a trademark in as many desired classes, so long as you plan to perform business activity within the class within the next 3 years.
