A local entity such as a limited liability company or corporation (Sociedad de Responsabilidad Limitada or Sociedad Anonima, respectively) in Mexico is not required if a product category only requires labeling modification and changes to packaging – most kitchenwares and furniture for instance. However, any product requiring certification, testing or local authorizations like cosmetics, dietary supplements, speakers, cameras or similar will require a local entity. Any regulatory certificates of conformity letters issued will also need to name a local Mexican entity. So in most cases, you will need to incorporate a local entity unless you have a local distributor or importer in Mexico, who can hold the local regulatory certifications on your behalf, and have the regulatory certificates of conformity issued under the distributor’s company name.
