Overview of NOM Compliance for Importing Cosmetics?

Cosmetics products can be imported into Mexico by obtaining proper compliance registrations and adhering to labeling requirements. Mexican product regulations are called NOMs. First, the importer must obtain an Operations Notice or Aviso de Funcionamiento with the Mexican healthcare authority, the Comisión Federal para la Protección contra Riesgos Sanitarios or COFEPRIS. The Operations Notice should list all the products the importer plans to sell or market in Mexico.

Second, each product intended for sale and importation should comply with Mexican label design regulations or NOMs, stating the required commercial information. Thereafter, the products may be imported and legally sold.

Do I need to incorporate a local entity
to import Cosmetics Products?

A local entity such as a limited liability company or corporation (Sociedad de Responsabilidad Limitada or Sociedad Anonima, respectively) in Mexico is required for the Aviso de Funcionamiento (Operations Notice). Any product conformity letters issued will also need to name a local Mexican entity. So, in most cases, you will need to incorporate a local entity,
unless you have a local distributor or importer in Mexico, who can process the Aviso de Funcionamiento
on your behalf and have the product conformity letters issued under the distributor’s company name.

What does the Mexican NOM compliance process for Cosmetics process involve?

The process is relatively straightforward. First, a complete list of the products intended for importation should be compiled along with the product’s safety data sheets and foreign labels. MexInc’s accredited laboratory will analyze the above information to determine what Mexican NOMs apply to the product – which will vary depending on the product’s ingredients, coloring and usage.

MexInc will then file the online-based Aviso de Funcionamiento for all of the products and proceed to issue the label design information. The importer can either choose to modify the physical packaging of their cosmetic products or simply place a sticker on the foreign packaging of the product that contains Mexico compliant labeling commercial information, warnings, and usage information.
